LGBTs-WHAT INDIAN PARLIAMENT CAN DO NOW? - INVESTIGATE FIRST, DISCUSS NEXT AND THEN LEGISLATE PLEASE

WHAT PARLIAMENT CAN DO NOW


This article is the sequel to the earlier article in this Blog on the same subject. The Supreme Court of India has rightly thrown the ball back into the Court of the Parliament where it rightly belongs - on the LGBT issue.


What the Parliament will do now - is anybody's Guess.

LGBT includes four categories of people :

Lesbian (women) :  Wikipedia says : “Lesbian is the term most widely used in the English language to describe romantic or sexual attraction between women. The word may be used as a noun, to refer to women who identify themselves or who are characterized by others as having the primary attribute of female homosexuality, or as an adjective, to describe characteristics of an object or activity related to female same-sex attraction.”

My comments : I have no great objection to Lesbianism as such. But, I strongly feel that it arises initially, out of normal sex instincts. When a young girl comes of age, sex instincts do arise in her. But, there are, many times genuine fears in aligning with a male – due to social constraints and also due to fears of pregnancy, rape etc.

Also, in certain supporting surroundings like a ladies Hostel where 2 girls are given a single room etc, when both feel sex instincts, they may initially get into what is normally called FOREPLAY in hetero sex – and enjoy it also. Since there are no side-effects in this as in hetero sex, they may get accustomed to it. Then, whenever they go out of the initial birth place of Lesbianism in them, they may start searching for lesbian partners once again.

Thus, change of rooms, change of partners may go on happening frequently in their lives. Unlike a Husband-wife relationship, where the Partners are fixed for LIFE, there is no such life-long fixation of partners. Out of sight-out of mind- find new ones – is likely to be the norm. We find placards – LOVE ISN’T A CRIME. Yes. Love is not a Crime. But, Lesbianism is not LOVE. It is Sex. It is physical attraction. But, Hetero sex has components of pure love plus physical attraction both.

A confirmed Lesbian’s search for new partners in new places does involve problems for other women who are Hetero-sexuals.  It involves unnatural , unacceptable behaviours, which are not immediately detected by the other person. But, a softer approach by the partner may turn the hetero sexual woman into Homo-Lesbian. The aggressive, LOVE-LESS, sexist approach of many Boys in current days may also turn away girls from Hetero sex into Homo-sex. Therefore, the causative factors merit great attention and perhaps, right education, inculcating respect towards other sex and mutual help, and strong sentiment against violence against women  may tend both boys and girls towards Hetero-friendships, which are socially better.

Despite this, I feel, Lesbianism is generally harmless and should not be considered a crime. My general feeling is – all ladies Hostels and such other places exclusive for women, must either have single rooms or rooms accommodating 4 or more females – but not rooms for just two females which could turn normal heterosexuals, including happily married ones into lesbianism, under the overtures of a confirmed Lesbian.

Gay (Men) : Wikipedia says : “Gay is a term that primarily refers to a homosexual person or the trait of being homosexual. The term was originally used to refer to feelings of being "carefree", "happy", or "bright and showy". The term's use as a reference to homosexuality may date as early as the late 19th century, but its use gradually increased in the 20th century.In modern English, gay has come to be used as an adjective, and as a noun, referring to the people, especially to males, and the practices and cultures associated with homosexuality.”

GAYISM is more disturbing than Lesbianism. GAYISM has been reported many times in respect of BOYS’ Hostels, where either bigger boys or the Male wardens force young, hapless, helpless boys into Gay sexual Behaviour. It was reported in the press many times and is common knowledge. This means that GAYISM – is not always a genetic Phenomenon – but is unnaturally acquired in such BOYS’ Hostels also – either from Bigger Boys or from Male wardens also. There are certain unnatural sex behaviours in GAYISM, like ANAL SEX, which may be forced on such younger Boys, by the older boys or the Male wardens, who ,when they become Bigger Boys may force other smaller Boys into it. This is happening and cannot be denied, as it has been reported frequently in the press also.

So, while part of GAY Behaviour may be Genetic – part of it is certainly acquired in such incidents. Many times, GAY BEHAVIOUR  may be  criminal behavior also, being forced on hapless, helpless younger boys, who have no one to complain to.

It is also reported in the previous article that the Government itself has told the Apex Court that there is Huge incidence of HIV among such persons.

Can the Parliament take hasty decisions based on the strident demands of LGBTs – ignoring the fact that at least a part of LGBT behavior is forced and not Genetic.

Also, I have mentioned the incident which happened in my own life in the previous article. A train driver abandoned the Engine, came into the first compartment and was trying to indulge in Gay sexual behavior with me when I was hardly 14-15 years of age. I ran away as fast as I could, at the very next station, far away from this GAY man. Therefore, based on my own personal experience, I know that GAY BEHAVIOUR does give problems to other male children – and eventually turn them also into GAY behavior.

When a confirmed GAY is either transferred to another place or has to go on tour to distant places, his sexual instincts are still in-tact and in all probability, he will be searching for another GAY among the hetero sexual. This search by the GAY person among Hetero sexuals is what I would strongly object to.

GAYs and LESBIANS can and do change partners when they have to change their places of stay or their partners have to change their places of stay. Is this sexual behavior or LOVE?

Consensual sex behavior is not what I am against. But, search for partners among heterosexuals and changing partners with change of places is what I am objecting to.

In the olden days, in India, we used to talk of DEEP FRIENDSHIPS among Males, and among FEMALES (exclusively). But, friendship between a Male and a Female was not encouraged, since this could turn into sexual behavior any day. Instead, males and females were encouraged to form Brother-sister relationship, Father-daughter relationship, Mother-son relationships and so on. We don’t talk of such deep , lasting, socially healthy, secure friendships any more. We always talk in terms of sexual relationships. This is the problem. GAY – is sexual. LESBIAN is sexual. The very terms are sexual in nature. LOVE  even among them, if it exists, is divine always.

In India, even a 90 year old man is supposed to call even a 5 year old girl as Maa, or, mother. A Boy must always treat any girl as Mother or sister which are socially healthy and enduring relationships. But, looking at even the same sex person merely as a sexual partner is not a healthy relationship. Also, searching for sex partners among the same sex person – is a problem for other persons.

Should it be treated as a crime or Not? Any person, trying to induce any other person, whether of same sex or different sex, into sexual behavior must be treated as crime.

What of consensual behavior in private between two mature Individuals? That, of course, is their purely private matter – and not a crime. Unless, one or both of them are married already to some others! Then, the least to be said is – it is IMMORAL.

The other categories of LGBTs, I am not discussing much. Bi-sexual – inherently means sex with more than one person – it is Immoral. Transgender – is perhaps a natural problem; a genetic problem. It needs all sympathy.

In Parliament, we all know that, many bills get passed without much discussion and when most MPs are absent from the House. Of late, voters vote in large numbers, much above 70% and some times more than 90% also. But, our vote getters, our representatives in Parliament and State legislatures tend to pass many crucial bills with far lesser percentage of polling / votes. Will they change now?

In General, I do not prefer making Lesbianism or GAYISM into a crime as such. But, I do prefer Parliament making legislation in such a way that these behaviours are not encouraged and in such a way that people already GAY or LESBIAN do not spread their behavior to other Hetero sexual.

PS : What US or UK does in such matters is not a Guide-Post for India always. India can set healthier examples. Many developed countries have hugely declining Populations - thanks to their  un-thought-out policies.

LGBT - Gay, Lesbian, Bisexual, Transgender - Normal or Abnormal - Homosexuality - crime or not? - - SUPREME COURT verdict - But not the Last word on LGBT

LGBT stands for  "Gay, Lesbian, Bisexual, Transgender".

The culture of LGBT is spreading like wildfire in Developed countries. India, in that sense, is fast becoming a Developed Country. 

But, Is LGBT a normal or abnormal phenomenon? 

In my view, anything that  does not serve a Normal Human purpose -  is abnormal. We must therefore have a clear Idea of what is NORMAL phenomenon in respect of Human society – so that we can clearly  recognize an abnormal phenomenon. Whatever is not normal need not necessarily be abnormal – but it can be super-normal – serving a much HIGHER HUMAN PURPOSE. If there is no such HIGHER HUMAN PURPOSE in a NON-NORMAL phenomenon, then, it must necessarily be considered abnormal, needing all possible efforts to bring it back to NORMAL.

Only, if the Society treats a phenomenon as abnormal can such a phenomenon be brought back to NORMAL. If an abnormality is also treated as Normal, apart from what is normally Normal, the abnormality can never be brought back to Normal.

Procreation is a NORMAL HUMAN PURPOSE. That, I feel, is beyond doubt and beyond question. It can be no Human Society’s intention to finish itself in this single generation itself – and leave the earth – all to animals, birds and insects. But, some countries are doing just that. If there is growth of population in those countries, it is only by immigration – and not by procreation. In some countries where LGBT phenomenon is high, the rates of procreation is so down that  population in those countries is said to be coming down in those countries – and all sorts of financial incentives are being offered for procreation, for an activity, which should actually be a hugely voluntary and enjoyable activity, if nature’s normal way prevails.

Probably Malthusian theory of Population is at work in those countries – albeit in Hitherto not understood ways. Malthus only thought that Nature will create floods, draughts, epidemics etc to reduce huge populations. He didn’t probably imagine that nature will make many people into LGBT – so that huge population growth in the country will be automatically brought under check. This could well be the truth – though, unsubstantiated by science; and probably incapable of experimental verification by science. Nature’s ways are too complicated in many respects for science to unravel easily.

LGBTs , at least some of them, claim that they are naturally born so – at Birth. This may be the case with some people. But definitely not with all LGBTs. Some people are converted into LGBTs by existing LGBTs, as I have seen it myself.

Almost 50 years back, when I was a boy of 15-16, I was traveling in a Local Train at Chennai,  just behind the Engine, in the first seat of the first Compartment of the train. The compartment had just 4-5 boys travelling in it. That’s all. It was a coal fired Engine in those days. The smell of coal was there all over. At each station, coal particles were emitted into all compartments.

At one station, one of the Drivers in the train came out of the Engine, and effortlessly jumped into the first compartment in which I was – and sat by my side. Within no time, he was opening my Pant buttons and putting his hand on my private parts. As a boy, I was too terrified to say or do anything at this sudden intrusion of my private parts. I did not know what he was doing and why – except that I felt it terribly wrong. The next station was within a few minutes and the Driver went back to the engine for doing his duties. Before he could come back – I jumped out on to the Plat form and ran as many compartments back as possible to be out of reach to him. I heard the Driver shouting from behind asking me to come back. It was a terrifying experience for me at that time.

I never ventured to sit in the first compartment thereafter for a long time. But, it was obvious that the Driver, a clear LGBT, was doing it all the time. He was in fact spreading his LGBT syndrome to many others. He must have been doing it at home and many other places, where he gets an unsuspecting victim.

Why I mention this is – two known Homosexuals, who know and accept each other, indulging in whatever they want with total consent, may perhaps be left to themselves. 

But, I strongly feel, that  some (probably many) LGBTs have a tendency to impart their syndrome to other unsuspecting victims and make them also eventually into LGBTs. In other words, it is not just  acquired by birth; but, it is also transmitted by existing LGBTs. I contest this claim that LGBTs are always so by Birth. No. some are turned into LGBTs later, by other LGBTs.

Therefore, I strongly appeal to the Society in general to ensure that this phenomenon is not treated as NORMAL. I am not saying that LGBTs must be treated unsympathetically – they can be given all the respect and assistance – that is needed , but, any exhibition of LGBT behavior in public must be discouraged. Also, any effort to indulge in their sexual behavior with strangers must be treated as CRIME. It is as bad as RAPE.

I do not know what the Supreme Court will say – But, based on my personal observation, this is what I propose I strongly feel, we cannot take the LGBTs version as final. There is need to ensure that normal heterosexuals are not turned into Homosexual behavior by existing Homosexuals. There is also need to see scientifically – why LGBTs are so – and see if they need any assistance. 

Like Drinks and Drugs, LGBT behavior could have been an acquired, habit-prone syndrome in many cases and may be Genetic also in some. Either way, there is no need to treat this as NORMAL, even if sexual behavior  between any two freely consenting LGBT Individuals  need not be treated as a crime.

11-Dec-2013 : Supreme Court Verdict :



The Supreme Court of India on 11-Dec-2013 (Wednesday) set aside the decision of the Delhi high court, which had in 2009 decriminalized sexual relation between persons belonging to same sex.

A bench consisting of justices G S Singhvi and S J Mukhopadhaya upheld the constitutional validity of Section 377 of Indian Penal Code that makes anal sex a punishable offense.






Parliament is authorized to remove Section 377, but as long as this provision is there, the court can not legalize this kind of sexual relationship, the SC bench observed.

"It is for the legislature to look into desirability of deleting section 377 of the IPC," the Supreme court said.

With the apex court verdict, the operation of penal provision against gay sex has come into force once again.



The Supreme Court passed the order on a batch of petitions of anti-gay right activists and social and religious organizations against the high court's verdict decriminalizing gay sex.



Section 377 (unnatural offenses) of IPC makes gay sex a criminal offense entailing punishment upto life imprisonment.

As some News says - The Centre had earlier informed the Supreme Court that there are an estimated 25 lakh gay people and about seven per cent (1.75 lakh) of them are HIV-infected.

From these statistics, it seems necessary to investigate - whether same Sex relations has an in-built danger of greater proliferation of HIV.

It is the Supreme Court's prerogative to test the constitutionality of the law and their verdict on homosexuality as an offense must be respected by the government, Law Minister Kapil Sibal said.

"It is the prerogative of the Supreme Court to judge the constitutionality and validity of the law. The opinion of the Supreme Court must be respected by the government. They have exercised their prerogative now, we shall exercise ours," Kapil Sibal told reporters outside parliament.





From all the developments on the issue - it seems that the  LAST WORD  is not said on the issue - Not as yet.
